Why Employers Should Regularly Ask Employees About Workplace Harassment

One of the biggest challenges in preventing workplace harassment is that employers often learn about problems months—or even years—after the misconduct begins. By then, memories have faded, witnesses may have left the organization, and the employer may have lost the opportunity to stop the behavior early. Employers should not wait for an employee to file a formal complaint before assessing whether problems exist.

A best practice is to incorporate a confidential workplace conduct acknowledgment into the payroll or HR process several times each year. Employees could be asked whether they have experienced or witnessed harassment, discrimination, or retaliation during the reporting period and whether they know how to report concerns. Responses should remain confidential and immediately trigger review by a neutral investigator whenever an employee indicates a concern.

The acknowledgment should never require employees to waive legal rights or certify that harassment has never occurred. Instead, it should simply establish a timeline by documenting whether an employee reported a concern during that period while making it clear that employees may raise concerns at any time. This process helps employers identify issues earlier, document when concerns were raised, and demonstrate that employees were regularly reminded of their reporting options.

Combined with a confidential reporting portal, regular harassment prevention training, and prompt, impartial investigations, periodic employee acknowledgments can become an important part of a comprehensive workplace compliance program. The goal is not simply to reduce legal liability—it is to create a culture where employees feel safe, respected, and confident that their concerns will be heard and addressed.
